Alternative Dispute Resolution: Why It Doesn’t Work and Why It Does

What keeps companies from saving time, money, and relationships is the wish to win rather than avoid litigation. Back in the s, experts and executives alike heralded alternative dispute resolution ADR as a sensible, cost-effective way to keep corporations out of court and away from the kind of litigation that devastates winners almost as much as losers. Over the next few years, more than large corporations adopted the ADR policy statement suggested by the Center for Public Resources, and many of these companies reported considerable savings in time and money. But the great hopes for ADR faded quickly. Damage awards, legal billings, and the number of lawsuits in the United States continued to rise—even for many of the companies that had embraced ADR. In fact, one study found that rather than reducing costs and delays, at least one form of ADR—court-annexed arbitration—had actually increased them.

Shaw and former Commission staff director Elizabeth Plapinger, who also served as reporter. Scope of Principles The following Principles were developed to offer a framework for responsible practice by entities that provide ADR services. In framing the nine Principles that comprise this document, the drafters tried to balance the need for clear and high standards of practice against the risks of over-regulating a new, diverse and dynamic field. The Principles are drafted to apply to the full variety of public, private and hybrid ADR provider organizations in our increasingly intertwined private and public systems of justice. The single set of Principles may also help alert the many kinds of entities providing ADR services of their essential, common responsibilities.

Alternative dispute resolution ADR , or external dispute resolution EDR , typically denotes a wide range of dispute resolution processes and techniques that act as a means for disagreeing parties to come to an agreement short of litigation : a collective term for the ways that parties can settle disputes, with the help of a third party. Despite historic resistance to ADR by many popular parties and their advocates, ADR has gained widespread acceptance among both the general public and the legal profession in recent years. In fact, some courts now require some parties to resort to ADR of some type, usually mediation , before permitting the parties' cases to be tried indeed the European Mediation Directive expressly contemplates so-called "compulsory" mediation; this means that attendance is compulsory, not that settlement must be reached through mediation. The rising popularity of ADR can be explained by the increasing caseload of traditional courts, the perception that ADR imposes fewer costs than litigation, a preference for confidentiality, and the desire of some parties to have greater control over the selection of the individual or individuals who will decide their dispute. Alternative dispute resolution ADR is generally classified into at least four types: negotiation , mediation , collaborative law , and arbitration.
